A registered trademark distinguishes a brand and protects its identity, but registration must be renewed periodically to remain in force. Timely renewal preserves statutory rights, commercial value, and the official Registry record connected with the mark.
In India, a trademark registration is generally valid for 10 years and may be renewed for successive 10-year periods. Missing the ordinary renewal deadline can lead to surcharge, removal, restoration proceedings, additional cost, and uncertainty for the brand.

Trademark Renewal is the procedure for extending an existing registration for another 10-year term. The registered proprietor or authorised representative files Form TM-R with the prescribed fee and accurate registration particulars.
A renewal request may generally be filed up to one year before expiry. If the registration expires without ordinary renewal, the proprietor may still seek renewal with surcharge within six months after expiry. Restoration and renewal may be requested within one year from expiry when the statutory conditions are met.
Renewal extends the existing registered rights; it is not an opportunity to replace the registered mark with a materially different mark. Ownership changes, proprietor details, and permitted alterations may require separate recordal procedures.
Section 25 of the Trade Marks Act, 1999 provides for the duration, renewal, removal, and restoration of registered trademarks. On receipt of a valid renewal request and prescribed fee, the Registrar renews the registration for another 10-year period.

Where the prescribed renewal form and fee are not received, the Registrar sends a notice concerning the approaching expiration and renewal conditions in accordance with the Trade Marks Rules.
If renewal is not completed, the Registrar may remove the trademark from the register and advertise the removal in the Trademark Journal. The registration should not be removed where a valid surcharge request is made in Form TM-R within six months from expiry.
Removal can interrupt statutory protection and create enforcement, licensing, investment, marketplace, and ownership risks. Proprietors should therefore maintain their own deadline records rather than rely solely on receiving a Registry reminder.
Renewal ordinarily continues the registration as it appears on the register. It does not permit substitution of a new trademark or a material alteration of the registered mark.
If a trademark is removed for failure to pay the renewal fee, the proprietor may apply for restoration and renewal in Form TM-R within one year from the expiration of the registration.
Restoration is discretionary. The Registrar considers the circumstances of the delay and the interests of other affected persons and may impose conditions or limitations when restoring the registration.
Confirm the expiry date, removal status, proprietor details, relevant Journal entries, and whether the one-year restoration period remains open.
Complete the restoration-and-renewal request with the correct registration particulars and relief sought.
Provide an accurate explanation and any supporting material required to show why renewal was not completed on time and why restoration should be allowed.
Submit the government fees prescribed for restoration, renewal, and any applicable surcharge through the authorised filing channel.
Address any discrepancy, objection, third-party interest, condition, or hearing direction raised during consideration of the request.
If allowed, the Registry restores and renews the mark, updates the record, notifies relevant parties, and advertises the restoration and renewal in the Trademark Journal.
Renewal is filed using Form TM-R rather than the former TM-12 form. Commonly required information and documents include:
Verify the registration number, proprietor, classes, expiry date, active status, registered users, assignments, limitations, and any pending proceeding before filing.
Identify whether the matter is an ordinary renewal, renewal with surcharge within six months after expiry, or restoration and renewal within one year from expiry.
Where the proprietor name, address, or ownership has changed, assess whether a separate recordal request should be filed before or alongside renewal.
Complete the current renewal or restoration form with accurate registration details, address for service, proprietor information, and the appropriate request type.
Pay the government fee applicable to ordinary renewal, late renewal with surcharge, or restoration and renewal. Fees should be checked against the official schedule in force on the filing date.
Submit Form TM-R and the required supporting documents through the Trade Marks Registry's authorised electronic filing system and retain the acknowledgement and payment receipt.
The Registry checks whether the mark is renewable, the request is timely, the proprietor details are consistent, the correct fee has been paid, and any outstanding discrepancy requires action.
If the Registry raises an issue, provide the required clarification, correction, document, fee, or hearing response within the period specified.
Once allowed, renewal is recorded for a further 10 years. The Registry sends notice to the proprietor and registered users and advertises renewal or restoration and renewal in the Trademark Journal.
The total cost can include the official renewal fee, professional service charges, and—where the deadline has passed—a surcharge or restoration fee. Separate charges may apply for ownership corrections, assignment recordal, hearings, or other related proceedings.
